How does H-1B cap-gap work for F-1 students?

Cap-gap automatically extends your F-1 status and, if you are on OPT, your work authorization until October 1, provided a cap-subject H-1B petition requesting a change of status was timely filed while your status or grace period was still valid. It is automatic — there is no separate application — but it ends immediately if the petition is denied, rejected, or withdrawn.

What cap-gap covers

Cap-gap fills the interval between the end of F-1 status or OPT and the October 1 start date of a cap-subject H-1B. Without it, students with H-1B petitions approved in the spring would fall out of status for months before their H-1B took effect.

Two different things can be extended, and the difference matters:

Conditions

The petition must be cap-subject, must request a change of status rather than consular processing, and must be timely filed while your F-1 status or grace period is still valid.

That middle condition is the one that quietly breaks cases. A petition filed for consular processing does not trigger cap-gap at all, even when everything else is in order.

When it ends

Cap-gap runs to September 30, with H-1B status beginning October 1. It terminates earlier if the petition is denied, rejected, revoked, or withdrawn — on the date of that action, not at the end of the period.

What to do

Ask your Designated School Official for an updated I-20 showing the cap-gap extension. You do not need it to remain in status, but employers and their I-9 processes frequently ask for it, and it is far easier to obtain in April than in September.
